A woman from Horry County, South Carolina, has sued Walmart and a delivery driver who claimed the driver was “gotcha” in her driveway after delivering groceries in July.
The lawsuit
The lawsuit, filed Dec. 19, alleges that Alvin B. Ortiz exposed himself in his vehicle after delivering groceries on July 8. The incident occurred around 9:10 a.m. local time Intracoastal Waterway Community. The woman, identified as “Jane Doe,” claims Ortiz, 39, remained in his car in her driveway for 10 to 15 minutes after giving birth. As she approached his vehicle, she said she saw “his pants being pulled down” and him “enjoying himself.”
The lawsuit says the woman retreated into her home with her child and called a neighbor for help. The neighbor confronted Ortiz, who then allegedly drove away and yelled, “He came back to get everyone up.” The woman reported the incident to police, who then contacted the Walmart where Ortiz was employed.
Indictment against Ortiz
Ortiz was arrested on July 9 and charged with indecent exposure. He was released on bail the next day and court records show his case remains pending.
Allegations against Walmart
The lawsuit accuses Walmart of failing to conduct background checks and holds the company responsible for its employees’ actions while on duty. The woman is seeking compensation for “past and future psychological pain and suffering, mental, emotional and psychological harm and loss of enjoyment of life,” including medical costs.
Walmart’s statement
Walmart told WMBF News, “The safety of our associates and customers is always our top priority” and mentioned that the company’s attorneys “will review the complaint and respond appropriately to the court.”
